The contract is concluded between the customer and the service provider when the customer initiates the payment. It does not qualify as a contract put in writing, it is not filed by the service provider and is not accessible afterwards; the confirmation of the purchase is shown on screen after payment and — if an e-mail address is given — may also be sent by e-mail. The customer is obliged to provide real data, to use the service as intended, and to refrain from any conduct that endangers the operation of the system or serves an unlawful purpose. The parties shall primarily settle disputes amicably. Failing that, the court with jurisdiction over the registered seat of the service provider shall proceed, and the law of the country of that registered seat shall govern.
If the customer selects a product cheaper than the amount paid, the service provider automatically refunds the difference to the card used for the payment. If the payment went through but the machine did not dispense the product, the full amount is refunded. Depending on the processing time of the issuing bank, a refund may take a few business days. It helps to state the time and amount of the payment and the location of the machine. The service provider investigates the complaint and replies within 30 days at the latest.

Data processor: Ivp Solution zrt, the operator and technical service provider of the system, processing customer data solely on the instructions of the data controller. Purpose of processing: carrying out the online payment, sending the confirmation and notification of the purchase, handling refunds, and — if the customer signs up — running the loyalty programme. Scope of data processed: the identifier, amount and time of the payment transaction, the identifier and location of the machine concerned, and — if the customer provides them — their e-mail address and chosen nickname for the loyalty programme and notifications. Card data (card number, expiry, CVC) is NOT seen or stored by the service provider: it is handled exclusively by the card acquirer (myPOS) on its own payment page. Cookies: the site uses no tracking or analytics cookies. It sets only cookies necessary for operation: the session identifier (to link the steps of the payment flow) and the remembered language choice. Cookies can be blocked in the browser — in that case the payment flow will not work properly. Legal basis: performance of a contract (GDPR Article 6(1)(b)); for the loyalty programme and e-mail notifications the customer's consent (Article 6(1)(a)); and for the secure operation of the system and the prevention of abuse the legitimate interest of the service provider (Article 6(1)(f)). Data transfers: to carry out the payment, transaction data is transferred to the card acquirer; e-mails are sent through a mail service provider. Apart from these, the service provider does not transfer personal data to third parties unless required by law. Retention: transaction data linked to accounting records is kept for the period required by law (8 years in Hungary); e-mail addresses until the customer leaves the loyalty programme or requests deletion. The data subject may at any time request information, access to the data processed about them, its rectification or erasure, or the restriction of processing, may object to the processing, and may lodge a complaint with the supervisory authority (in Hungary the National Authority for Data Protection and Freedom of Information, NAIH) or with a court. Proba kave kft takes all reasonable measures to keep the machines running properly, but assumes no liability for mechanical failure of a machine, temporary gaps in stock, or the quality of the goods sold in the machine. Card payment takes place on the secure interface of the card acquirer (myPOS); the service provider handles no card data and is not liable for damage arising from a failure of the banking system or of the customer's device. The service provider is not liable for interruption of the internet connection, IT system failure, malfunction caused by a third party, or any event beyond its control. The refund of amounts paid but not used is arranged by the service provider through the card acquirer; the actual time of crediting depends on bank settlement. By using the service the customer accepts the provisions of this disclaimer.
